Interestingly I forwarded a comment and recommendations on the auDA Code to
this list (cc'd directly to Jo) on the 22nd October - however it has
seemingly failed to be included on the auDA web. I am quite willing to
accept that the reason for this was my formatting of the document as a
'plain English' proposal, probably construed (and subsequently deleted) as a
generic posting. The posting and recommendation is reproduced below, however
I will recreate the document into a formal submission later today.

For those who may not be aware, Belgium is also in the process of developing
a Code of Conduct for the .be namespace. In summary; "DNS Belgium wants to
establish a code of conduct for its agents that will contain a significant
number of principles in order to protect the end user. The code will also
introduce a quality label for the agents that sign the code".

The Belgian draft (seemingly based on the same model as the auDA draft),
contains numerous worthwhile additions - notably in the areas of consumer
protection; penalties for a breach of the code, and; a marketable quality
assurance label designed to foster community confidence - A few examples
follow:

Customer Quality Principles

4. Registrars will refrain from practices to initiate transfers for .be
domains without prior demand of their customers.

Privacy Policy Principles

1. Registrars will develop or maintain a clear privacy policy and will
inform their customers of that policy.

2. Registrars will withhold from spamming potential or existing customers in
order to persuade them to make use of their services.

3. Registrars will not transmit the personal data of their customers to
third parties.

The .be draft contains many other important additions (too numerous to list
here) and I do urge all persons interested in the draft auDA Code to peruse

In closing, may I recommend that auDA adopt the conventions of ICANN and
other registry authorities by naming the draft code a 'Code of Conduct'
rather than a 'Code of Practice', and to adopt the Belgian draft and
methodologies as a base template for further .au conduct policy formulation
(amended as appropriate with Australian statutory and other references).
