You never own an AU domain name, you only get a license to use it. Anyone who meets the criteria of allocation and eligibility (see http://www.auda.org.au/docs/auda-2002-07.txt) for any particular AU domain, can register for a license for that domain (provided it is available!). Inevitably, some people register domain names that are never used. It doesn't matter why they never chose to use it, they hold the license to use and that is enough to stop anyone else using it.
