Without Prejudice

"Sophistry" big word Chris, and by the way didn't auDA post the consumer
alert on Uregister.com.au before we replied to there demands?

For your knowledge 500 letters were posted from Uregisters misleading
mail out.

No I don't think I should past my personal opinions past a lawyer every
time, like you probably do, throwing auDA money away and trying to bully
others.

And uregister.com.au has not done any promotional advertising or mail
outs for the .au space since the consumer alert was posted on us and we
are not planning on doing so unless we passed the letters or promotional
material passed auDA so I do not know what you are talking about. Isn't
auDA the .au Domain Administration Ltd (auDA) responsibility of
operating the .au domain. What power do you think you have when I am
marketing another product which has nothing to do with you.

Daniel,

As regular DNS List watchers will know, I rarely post to the list.
However, on this occasion, I am simply not prepared to allow your
attempts at sophistry to go unanswered.

No consumer alert was issued because unlike your mail out, we were able
to ascertain the precise number of letters that were sent and to whom
and ensure that those people received a corrective letter.

auDA only issues Consumer Alerts where it is concerned that a
substantial but unidentifiable portion of domain name registrants could
be effected. This was not the case here.

I realise that you are inexperienced in business and commerce and so,
may I suggest that in future, should you wish to post comments such as
those below, you run them past your lawyers first. As I am sure they
will explain to you, your use of the term Without Prejudice is self
serving and provides you with no protection whatsoever. Hopefully, your
lawyers will also be able to provide you with some guidance on the laws
of defamation.

Regards,

Without Prejudice, I think that's why we need a royal commission looking
over auDA, some thing is happening under the table, I reckon.

In MIT's defence they have agreed to mail all registrants (1500) with a
corrective letter. They have also run a corrective message on their web
sites front page. What's the point of independant investigation that's
why
we have auda to oversee the .au namespace.

Without Prejudice. That's real funny the Melbourne IT mail out. If it
was any other registrar I'm sure there accreditation would have been
taken off them. Also why is there no consumer alert on Melbourne IT they
have done a mail out which is breaching the .au Domain Name Suppliers'
Code of Practice. Uregister.com.au did a mail out which breached the .au
Domain Name Suppliers' Code of Practice. It got listed on auDA consumer
alerts even though at the time were not bound by the .au Domain Name
Suppliers' Code of Practice. I think an independent investigation needs
to be conducted.
