Goodwill aside, Deus Ex Machina's isnt going to come out and say it on this list, as it could be easily misconstrued, interepreted incorrectly, and have someone saying that he / enetica agreed to something that in fact they did not. Inadvertantly Entrapping him, or any other registrar for that matter. What *I* took from his statement earlier was that: : Enetica will not knowingly approach clients, as that's pretty crabby, in both resellers view, and the ethics of Deus. : If a client comes across his site however, he can't be held responsible for that, and of course theres going to be marketing marterial of interest to the client. : A client will have a likely expectation of going to Enetica's site, or any Registrars site, at some stage during their domain name leasing / allocation experience. (Auda thingy, beyond Registrars control). And in general, - Its not the registrars imposition of policy that the contract is between them and the end domain name recipient. - A reseller has rights to market its products directly, its a commercial interest after all. - An end user is likely to go to the registrars site at some stage, and come across these products. How the heck can he say your clients wont receive exposure to this? he cant, no registrar can unless the are reseller only. And so? A reseller is exactly that. A reseller. The accredited, respectable, watchdogged entitiy is the Registrar. You have to pay for prestige, respect, and also be made accountable for the position of authority that you have. Clients need a direct line to this position of prestige, respect, and authority. Otherwise the .au namespace itself comes into disrepute. I welcome any rebuttals from anyone who has an argument that actively suggests they wish to plunge .au into further disrepute. -Sean. -----Original Message----- From: Richard Keeves [mailto:richard§ibc.com.au] Sent: Tuesday, 24 June 2003 3:14 PM To: dns§lists.auda.org.au Subject: Re: [DNS] Enetica ----- Original Message ----- From: "Deus Ex Machina" <vicc§cia.com.au> > thats one interpretation however Enetica cant say it wont market to > a resellers customer because say it puts an ad somwhere and the end customer > saw it, it would be in breach of the contract. > > what it does say is there is nothing Enetica offers through retail that > a reseller cant offer through the reseller interface. so Enetica is contractually > bound not to gain a competitive advantage by offering a product that > resellers dont also get to use. > > Vic Vic, the point here is *not* that Enetica (ie presumably you) might run an ad that some client of mine (for example) might see, it is that you might directly target my client with a direct mail/fax/email and try to get them to deal direct with you - for domain reg/hosting or whatever other services you might want to offer. The fact that you are *not* saying that you will *not* target my clients directly is concerning. It would be *very* easy for you to come out and say that you will not compete directly against your channel for business coming from clients introduced to you by your channel. But you are NOT saying that. You seem to be saying that you think it is ok for you to compete directly with us for our clients. And you seem to be blaming small market size and sasha for that. Not sure if you know it or not, but the goodwill that existed for Enetica could rise or fall pretty easily here. Enetica provides great services and we have enjoyed the relationship - but if you can not say that you will not compete with us for our own clients, then we have to find an alternative. Believe me, it is preferable for us - and I would have thought also for you - that we continue to work with you. But we are not going to feed a growing threat. cheers Richard ps i have emailed to you privately - but you have not responded. --------------------------------------------------------------------------- List policy, unsubscribing and archives => http://www.auda.org.au/list/dns/ Please do not retransmit articles on this list without permission of the author, further information at the above URL.
