3. Names are Important

4. The DNS structure is pretty flat

ergo 

5. Names WILL clash.

and as a consequence of  of Important Names Clashing, 

6. This is a problem

The issue is NOT how to prevent the clash. The issue is to get out of the
legal feeding frenzy as an aftermath of each and every clash.
